Terms & Conditions
1. Applicability
These Terms and Conditions apply to all registrations, participation, and associated services provided by ArtéBallét Intensive (“AEBI”), registered in the Netherlands. By submitting an application, the participant or their legal guardian confirms full acceptance of these Terms and Conditions.
Participants under the age of eighteen (18) may only participate with the written consent of a legal guardian, who accepts these Terms and Conditions on their behalf upon submitting the application form.
2. Registration & Payment
Registration becomes binding upon submission of the application and issuance of an invoice by ArtéBallét.
A limited fourteen (14) day goodwill withdrawal period applies in accordance with Article 3 of these Terms; this goodwill withdrawal period does not constitute a statutory right of withdrawal and does not guarantee acceptance, placement, or participation.
A participant’s place in the program is confirmed only once all of the following conditions have been met:
full payment of the invoiced amount has been received;
availability within the relevant program and level has been confirmed; and
written confirmation of participation has been issued by ArtéBallét.
Submission of an application, payment of any fees, completion of full payment, or initiation of a chargeback or payment dispute does not in itself guarantee participation, nor does it release the participant from their contractual obligations under these Terms. Placement is subject to availability, level suitability, and final written confirmation by ArtéBallét, at the sole discretion of the Artistic Director.
Advanced / Pre-Professional Program
Participation in the Advanced / Pre-Professional Program requires a mandatory non-refundable audition fee of €35.00, payable upon submission of the audition application.
This audition fee is non-refundable under all circumstances, including rejection or non-acceptance.
The fourteen (14) day goodwill withdrawal period (as described in Article 3) commences only once the applicant has been formally accepted into the program.
Intermediate Program
No audition is required.
Participation in the Intermediate Program requires a mandatory non-refundable application deposit of €100.00, payable upon submission of the registration form. Of this amount, €30.00 constitutes a non-refundable application fee. The remaining €70.00 constitutes a provisional tuition credit.
If an application cannot be accepted by ArtéBallét due to capacity limitations or program-related reasons, or if the program is cancelled by ArtéBallét prior to written confirmation of participation, the provisional tuition credit (€70.00) will be refunded. The application fee (€30.00) remains non-refundable at all times.
The fourteen (14) day goodwill withdrawal period (as described in Article 3) begins upon submission of the registration form and applies solely to the registration agreement, without guaranteeing participation or placement.
For All Programs
Audition fees and application deposits are required to process applications and are non-refundable except as expressly stated in these Terms.
All payments must be received within thirty (30) calendar days of the invoice date or prior to the start of the program, whichever comes first, unless otherwise agreed in writing.
Failure to complete payment does not constitute cancellation and does not release the participant from the obligation to pay the full tuition fee once the registration has become binding.
Optional add-ons, including but not limited to private coaching and professional photoshoots, must be paid in advance to secure the reservation.
All payments are securely processed through Stripe B.V. and are subject to its applicable payment terms and conditions.
3. Cancellation, Withdrawal & Credit Policy
AEBI is a cultural leisure activity program scheduled for a specific period and is therefore exempt from the statutory EU right of withdrawal under Article 6:230p of the Dutch Civil Code.
As a gesture of goodwill, AEBI voluntarily offers a fourteen (14) day withdrawal period under the conditions outlined below. This goodwill withdrawal period does not constitute a statutory right of withdrawal.
Goodwill Withdrawal Period
Intermediate Program: the goodwill withdrawal period begins upon submission of the registration form.
Advanced / Pre-Professional Program: the goodwill withdrawal period begins only upon formal written acceptance into the program.
If an applicant to the Advanced / Pre-Professional Program is not accepted, they may be offered placement in the Intermediate Program. If the applicant does not wish to participate in the Intermediate Program, they must notify AEBI in writing before the original goodwill withdrawal period expires. The goodwill withdrawal period does not restart upon reassignment.
If no such notification is received within the applicable period, participation in the offered program becomes fully binding, and the applicable tuition fee remains payable in full.
Refunds vs Credits
Refunds apply exclusively in the following situations:
ArtéBallét is unable to offer a place after registration; or
the program is cancelled by ArtéBallét prior to the start date.
In such cases, the provisional tuition credit (€70.00) will be refunded. Application fees and audition fees remain non-refundable at all times.
In all other cases of participant-initiated cancellation after registration, no refunds will be issued. Instead, AEBI will issue a non-transferable credit voucher equal to the paid tuition amount (excluding the audition fee or application fee).
Credits:
are valid for twelve (12) months from the date of issue;
have no cash value;
are non-transferable;
may not be exchanged for alternative services.
Credits are granted only if cancellation is submitted in writing before the program start date via info@arteballetintensive.com.
Binding Enrollment & Payment Obligation
After expiration of the fourteen (14) day goodwill withdrawal period, enrollment becomes fully binding.
The full tuition fee remains payable in full, regardless of cancellation, withdrawal, non-attendance, illness, injury, personal circumstances, or travel disruptions, unless otherwise agreed in writing by ArtéBallét.
4. Program Changes, Level Placement & Cancellation by AEBI
AEBI reserves the right to make changes to the program content, faculty lineup, schedule, time slots, studio or performance locations, and overall program structure when reasonably necessary for artistic, logistical, or operational reasons.
Such changes do not constitute grounds for cancellation or refund. By enrolling, participants accept the inherent flexibility required in international dance programs.
ArtéBallét reserves the right to adjust a participant’s level placement at any time, before or during the program, if deemed necessary by the artistic staff or Artistic Director. Level changes do not entitle the participant to a refund or credit.
In cases of cancellation due to force majeure (including but not limited to natural disasters, war, pandemics, or governmental restrictions), participants will receive a credit voucher in accordance with Article 3.
In the unlikely event of full cancellation by AEBI for internal reasons (excluding force majeure), all payments excluding the audition fee or application fee will be refunded.
5. Limitation of Liability
Participation is at the participant’s own risk. AEBI is not liable for personal injury, illness, medical expenses, travel disruptions, property damage, theft, or loss incurred during or in connection with the program.
Participants are strongly advised to obtain adequate travel, medical, and personal liability insurance.
AEBI is not responsible for third-party service providers, including accommodation, transportation, or visa arrangements.
6. Use of Image, Video & Likeness
By participating in AEBI, the participant (or legal guardian if under sixteen (16)) grants ArtéBallét the irrevocable right to capture and use their likeness via photo and video for promotional, educational, and archival purposes, including but not limited to use on AEBI’s website, social media channels, printed materials, and advertisements.
This includes, but is not limited to, images and recordings captured during classes, rehearsals, photoshoots, performances, and related activities.
Participants who do not wish to be photographed or filmed for promotional purposes must notify ArtéBallét in writing prior to the start of the program. ArtéBallét will make reasonable efforts to accommodate such requests; however, due to the nature of group classes, rehearsals, performances, and live documentation, ArtéBallét cannot guarantee that participants will not appear incidentally in photo or video materials, including background or wide-angle footage.
By enrolling, participants acknowledge and accept this limitation and waive any claims arising from incidental appearance in visual materials, provided that ArtéBallét has acted in good faith and with reasonable care.
Participants waive any right to compensation, royalties, or claims for damages arising from such lawful use.
7. Health, Safety & Code of Conduct
Participants must disclose relevant medical conditions upon registration.
The use or possession of alcohol, illicit substances, or mind-altering drugs during the program is strictly prohibited.
ArtéBallét reserves the right to refuse or terminate participation at any stage if a participant’s conduct, physical condition, or technical level is deemed unsafe, disruptive, or incompatible with the program.
Any participant violating the Code of Conduct may be dismissed without refund or credit, at the sole discretion of ArtéBallét.
8. Personal Property
AEBI accepts no responsibility for lost, stolen, or damaged personal belongings brought to the program.
9. Governing Law, Jurisdiction & Language
These Terms and Conditions are governed by Dutch law. All disputes shall fall under the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
In the event of any discrepancy or interpretation issue, the English version of these Terms and Conditions shall prevail.
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
